Agreement to Terms
By downloading, installing, or using PulseLyrics, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the app.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of PulseLyrics ("the App"), a lyrics display application for iOS devices. By using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. License Grant
2.1 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on iOS devices that you own or control
- Use the App for personal, non-commercial purposes
- Access the App's features and functionality as intended
2.2 License Restrictions
You agree NOT to:
- Copy, modify, or create derivative works based on the App
- Reverse engineer, decompile, or disassemble the App
- Remove, alter, or obscure any proprietary notices on the App
- Use the App for any commercial purpose without our written permission
- Attempt to gain unauthorized access to the App's systems or networks
- Use the App in any way that violates applicable laws or regulations
- Distribute, sublicense, rent, lease, or lend the App to third parties
3. App Functionality
3.1 Service Description
PulseLyrics provides the following features:
- Display of synchronized lyrics for currently playing songs
- Integration with Apple Music and other music players on iOS
- Home Screen widgets for quick lyrics access
- Live Activities and Dynamic Island support
- Local caching of lyrics for offline viewing
3.2 Requirements
To use the App, you must:
- Have a compatible iOS device
- Grant necessary permissions for media library access
- Have an active music player (Apple Music or compatible apps)
- Maintain an internet connection for initial lyrics download
4. User Responsibilities
4.1 Proper Use
You are responsible for:
- Maintaining the security of your device
- All activities that occur through your use of the App
- Ensuring your use complies with all applicable laws
- Using the App in accordance with these Terms
4.2 Prohibited Conduct
You must not:
- Use the App in any manner that could damage, disable, or impair the App
- Attempt to interfere with the App's operation
- Use automated systems or software to extract data from the App
- Use the App to infringe upon intellectual property rights
5. Intellectual Property Rights
5.1 Ownership
The App and all related materials, including but not limited to software, designs, text, graphics, and logos, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.
5.2 Lyrics Content
Lyrics displayed in the App are sourced from third-party providers and are subject to their respective copyrights. The App does not claim ownership of lyrics content. Users must respect all applicable copyright laws regarding lyrics and song content.
5.3 Trademarks
PulseLyrics, the app icon, and related marks are trademarks owned by us. You may not use these marks without our prior written permission.
6. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the App will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy, reliability, or completeness of lyrics content
- Warranties that defects will be corrected
We do not guarantee that the App will meet your requirements or that lyrics will be available for all songs.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid for the App (if applicable) or $10 USD, whichever is greater
- We are not responsible for any loss of data, interruption of service, or other issues arising from your use of the App
- We are not liable for any third-party content, including lyrics accuracy or availability
8. Updates and Modifications
8.1 App Updates
We may release updates, patches, or new versions of the App from time to time. These updates may:
- Add, modify, or remove features
- Fix bugs and improve performance
- Enhance security
- Change the App's appearance or functionality
You may need to update the App to continue using it.
8.2 Terms Modifications
We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms with a new "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms.
9. Termination
9.1 Termination by You
You may stop using the App at any time by deleting it from your device.
9.2 Termination by Us
We reserve the right to:
- Suspend or terminate your access to the App at any time
- Discontinue the App or any features
- Terminate these Terms if you violate any provision
9.3 Effect of Termination
Upon termination:
- Your license to use the App will immediately cease
- You must delete all copies of the App from your devices
- Sections of these Terms that by their nature should survive will continue to apply
10. Third-Party Services
The App may integrate with third-party services such as Apple Music. Your use of these services is subject to their respective terms and policies. We are not responsible for any third-party services or their content.
11. Geographic Restrictions
The App may not be available in all countries or regions. Lyrics availability may vary based on your location and the agreements between content providers and your region.
12. Indemnification
You agree to indemnify, defend, and hold harmless PulseLyrics, its developers, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Your violation of any applicable laws or regulations
13. Governing Law and Disputes
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to conflict of law principles.
13.2 Dispute Resolution
Any disputes arising from these Terms or your use of the App should first be addressed by contacting us directly. We will attempt to resolve disputes in good faith.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PulseLyrics regarding the App and supersede any prior agreements.
